Appeals
The firm’s Litigation Department handles appeals for foreclosures, bankruptcies, as well as general civil litigation. The firm’s Managing Shareholder has represented clients in over 170 appellate matters. This area of the practice is managed by the firm’s Managing Litigation Partner, who has provided appellate services to the default industry for over a decade and has handled over 70 appellate cases. The firm has been a leader in shaping the landscape of the law within the default industry.
Deficiency Actions
The Firm handles deficiency actions either through a foreclosure or by a separate action. In addition, The Firm also handles deficiency matters through a debtor’s bankruptcy estate when appropriate.
Consumer Finance Litigation
The firm’s Litigation Department is experienced in providing defense litigation support to servicers and investors in actions regarding FDCPA, TCPA, FCRA, RESPA, and FCCPA. The firm’s attorneys focus on quickly identifying risk in these matters by formulating a litigation plan and strategy to either resolve these matters quickly through settlement or a plan to defend through trial if necessary.
Commercial / General Litigation
The Firm maintains a general practice commercial litigation group that involves business disputes, contractual disputes, insurance disputes, business torts, fraud, breach of fiduciary duties, joint venture disputes, civil appeals, and select general commercial disputes.
Evictions
The Firm maintains an Eviction Department devoted to timely prosecuting evictions. The Firm understands all aspects of Federal, State, and Local laws that affect evictions and works diligently to advise its clients of their rights in each state the firm practices.
